MULTI-ITEM TRIP PROTECTION TERMS AND CONDITIONS
These terms and conditions ("Terms") set out the legal terms on which Multi-Item Trip Protection is made available to you through our Service in connection with certain eligible Multi-Item Trips.
In these Terms:
- "we," "us" or "our" refer to Expedia, Inc.
- "you" refers to the person using our Service.
- "our Service" refers to the provision of our websites, apps and online tools.
- "Booking Confirmation" means your booking confirmation email.
- "Package" means separate Travel Services booked together at the same time through our Service.
- "Rules and Restrictions" means the terms and conditions provided by Travel Providers that apply to your booking.
- "Travel Provider" means the travel supplier making available the Travel Services to you through our Service.
- "Travel Services" means the travel services made available to you by the relevant Travel Provider or Travel Providers through our Service, such as stays at a property, flights, car rental or things to do.
- "Multi-Item Trip" means two or more of the following Travel Services booked through our Service for the same trip/itinerary: a Package, property, car rental or things to do booking added to a flight booking for that same trip/itinerary, a property booking added to another property booking for that same trip/itinerary, or a car rental or things to do booking added to a property booking for that same trip/itinerary.
Multi-Item Trip Protection is a limited support feature intended to help keep Travel Services in the same Multi-Item Trip aligned after certain disruptions. It is not a guarantee of satisfaction or a money-back guarantee, and does not take the place of insurance.
These Terms describe only the limited support that may be made available under Multi-Item Trip Protection. Any standard servicing, refund, relocation, error-correction, or other remedies we may otherwise provide under applicable policies or Rules and Restrictions remain separate from this feature and are outside the scope of these Terms.
We make Travel Services available to you through our Service, and the relevant Travel Provider provides the Travel Services. Travel Services included in a Multi-Item Trip remain subject to the applicable Rules and Restrictions. These Terms do not alter any agreement between you and a Travel Provider, except that we may provide the limited assistance described below in our sole discretion.
What Does Multi-Item Trip Protection Provide?
Multi-Item Trip Protection provides only limited support after certain covered disruptions to help keep other Travel Services in the same Multi-Item Trip aligned.
These Terms address only three categories of incidents:
- Certain flight disruptions that materially affect other Travel Services in the same Multi-Item Trip.
- Certain property disruptions that materially affect other Travel Services in the same Multi-Item Trip.
- Certain car rental disruptions that materially affect other Travel Services in the same Multi-Item Trip.
These are the only incidents covered by these Terms. We will not provide relief, reimbursement, or other assistance under these Terms for any other reason.
What Help May We Provide?
Assistance is available only where expressly provided for the applicable eligible incident. Depending on the incident, we may, in our sole discretion, assist with adjusting related Travel Services in the same Multi-Item Trip, facilitate or provide refunds, permit cancellation without penalty, or provide other assistance described in the applicable section below.
The type, amount, timing, and combination of any relief is entirely up to us. You are not entitled to choose the form of assistance you receive.
Who Is Eligible for Help Under These Terms?
Only travelers whose eligible Multi-Item Trip is booked through our Service and reflected in a Booking Confirmation may seek assistance under these Terms.
To remain eligible, you must:
- book the applicable Travel Services through our Service;
- comply with these Terms and the applicable Rules and Restrictions;
- provide accurate booking, traveler, and payment information;
- cooperate with us and the relevant Travel Providers in resolving the issue;
- provide requested information or documentation in a timely manner; and
- accept the terms of our payment processors and service providers as needed to process any rebooking, payment, credit, or refund.
Before we provide any payment or refund under these Terms, we may require you to pursue available remedies from the relevant Travel Provider, payment provider, or both. We will not make duplicate payments for amounts refunded, reversed, credited, or otherwise recovered from another source.
Eligible Flight Disruptions
We may provide assistance under these Terms when a Travel Provider causes a flight Travel Service in a Multi-Item Trip to have one of the following disruptions and that disruption materially affects other Travel Services in the same Multi-Item Trip:
- a departure moved to the next day;
- a flight cancelled and rebooked on the next day;
- a delay making a connection impossible;
- a departure or arrival airport is changed; or
- there is a significant schedule change, such as a change of more than 12 hours.
For qualifying flight disruptions, we may, in our sole discretion:
- assist with adjusting property check-in or check-out dates if needed due to departure date change;
- assist with booking or changing a property night if needed due to a departure or arrival airport change
- book or change a property night if needed because a connecting flight delay causes next-day departure;
- assist with adjusting car rental pick-up or drop-off dates or times to match the updated flight;
- assist with adjusting things to do where feasible;
- in split-ticket scenarios, assist with rebooking the second flight to align with the changed original flight; or
- permit you to cancel the trip for a full refund without penalty.
Flight disruptions are not covered under these Terms if they do not disrupt other Travel Services booked through our Service as part of the same Multi-Item Trip. Being denied service due to lack of required documentation, failure to meet Travel Provider requirements, failure to make any required payment, and lost luggage are not eligible disruptions under these Terms.
Eligible Property Stay Disruptions
We may provide assistance under these Terms when a Travel Provider causes a property stay Travel Service in a Multi-Item Trip to become unavailable due to availability issues or overbooking and that disruption materially affects other Travel Services in the same Multi-Item Trip as we determine appropriate.
For qualifying property stay disruptions, we may, in our sole discretion, assist with adjusting related Travel Services in the same Multi-Item Trip as we determine appropriate.
Property stay disruptions are not eligible under these Terms if they do not disrupt other Travel Services booked through our Service as part of the same Multi-Item Trip. Being denied service due to lack of required documentation, failure to meet Travel Provider requirements, failure to make any required payment or deposit, or dissatisfaction with a property are not covered disruptions under these Terms.
Eligible Car Rental Disruptions
We may provide assistance under these Terms when a Travel Provider causes a car rental Travel Service in a Multi-Item Trip to become unavailable due to the car rental location being closed during booked hours, and that disruption materially affects other Travel Services in the same Multi-Item Trip.
- For qualifying car rental disruptions, we may, in our sole discretion, assist with adjusting other Travel Services in the same Multi-Item Trip as we determine appropriate.
Car rental disruptions are not eligible under these Terms if they do not disrupt other Travel Services booked through our Service as part of the same Multi-Item Trip. Being denied service due to lack of required documentation, failure to meet Travel Provider requirements, failure to make any required payment or deposit, or dissatisfaction with a car rental do not qualify as disruptions under these Terms.
Unsupported Situations
In addition to the product-specific scenarios described above, we will not provide assistance under these Terms for:
- health or personal reasons;
- voluntary changes requested by you;
- documentation, planning, visa, passport, entry, or similar trip-preparation issues;
- traveler-caused travel disruption;
- weather, strikes, civil unrest, or other external events that do not cause the relevant Travel Provider to make a change to the booked Travel Service;
- requests to change to a different origin or destination; or
- requests for changes outside a reasonable date or time window, as determined by us.
Customer Cooperation and Notice
If we have contacted you about a disruption that affects another of your Travel Services in the same Multi-Item Trip, you must promptly respond to our notification as instructed in that notification and cooperate in good faith with us and the relevant Travel Provider. If you believe you have an eligible disruption that affects another of your Travel Services in the same Multi-Item Trip and we have not contacted you, you must promptly notify us and cooperate in good faith with us and the relevant Travel Provider. We may deny or limit assistance if you delay reporting the issue, refuse reasonable alternatives, fail to cooperate, or fail to provide requested documentation.
We will use commercially reasonable judgment to determine whether a disruption is covered, whether assistance is appropriate, what form of assistance to provide, and the amount of any payment, credit, or refund.
No Modification of These Terms by Customer Service
If a customer service representative provides information that differs from these Terms, these Terms control how we administer this program.
Changes and Termination
We may modify, suspend, or terminate Multi-Item Trip Protection and these Terms at any time, except that we will apply the version in effect when the eligible Multi-Item Trip was booked, unless applicable law requires otherwise.
