EG Labs Terms of Service

Thank you for taking the time to read these important additional terms of service for your interaction with EG Labs. EG Labs, the EG Labs logo, Expedia Rewards, and the Airplane Logo, among others, are trademarks or registered trademarks of Expedia, Inc. Other logos, marks, or company names included on any part of this website, application, online tool, products, or otherwise may be trademarks of their respective owners.

These terms are important as they, together with our applicable brand TERMS OF SERVICE (“General Terms”), set out the legal terms on which any part of this website, application, or online tool (the “EG Labs Site”) is made available to you. Your use of the EG Labs Site together with any other of our Service or Sites, including booking any Travel Service (each as defined in the General Terms) is conditioned upon your acceptance of each of these terms and the General Terms. The General Terms include an arbitration agreement and class action waiver that apply to claims brought against us. Please read them carefully. If you do not accept each of these terms and the General Terms, then please do not use the EG Labs Site, our Service or other Sites, or book a Travel Service.

We may change these terms at any time and your future use of the EG Labs Site, our Service or other Sites following changes to these terms is subject to you accepting those updated terms. We recommend that you save or print a copy of these terms and the General Terms.

Interactions with products, features, and services

By using the EG Labs Site, you acknowledge that its products, features, and services ("Offerings”) are experimental and may function incompletely, inadequately, or not at all due to engineering, testing, or deprecation. Use of the EG Labs Site and its Offerings is at your own risk. We may give you access to certain pre-production products and services that: (1) are not yet suitable for use in a production environment, (2) may not be feature complete, (3) may not have a specific service level agreement provided, and (4) have no technical support provided. Pre-production products and services may not be released beyond the initial pre-production version and may be deprecated at any time and in our sole discretion. THE EG LABS SITE, ITS OFFERINGS, AND ITS UNDERLYING SOFTWARE ARE MADE AVAILABLE TO YOU ON AN “AS-IS” BASIS WITHOUT WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. Any reverse engineering or disassembling any of the Offerings or EG Labs Site software by you, or any others under your direction, is expressly prohibited. Furthermore, use the pre-production products and services must be solely in a non-production environment as provided, unless we explicitly permit a broader scope of use in writing.

Certain Offerings may include the use of generative artificial intelligence (AI) technology or models, including technology provided by OpenAI™ such as ChatGPT API, GPT-3, GPT-4, GPT-Enterprise or other models. Such Offerings may (and may be required by the use of such technology to) store and use data corresponding to your interactions, including, for example, your conversations with or for one or more of the Offerings to optimize, maintain, update, train, retrain, or otherwise improve one or more generative AI technologies and/or models (hereinafter “generative AI models”). We are committed to the privacy, confidentiality, and security of any personal information entrusted to us. Please refer to our Privacy Statement and the General Terms to understand our practices.

Generative AI models are made available through our Service to enable you to help test our pre-production products and services. The pre-production products and services, including outputs from any generative AI models, may sometimes provide inaccurate or offensive content that doesn’t represent our views. Your use of the pre-production products and services as well as any generative AI models is entirely at your own risk and we do not make any promises, assurances, or guarantees on the accuracy or completeness of the content or outputs provided by the pre-production products and services. Please use discretion before relying on, publishing, or using content or outputs provided by the pre-production products and services. For instance, do not rely on the pre-production products and services for any professional advice, and any such content is provided for informational purposes only and is not a substitute for advice from a qualified professional.

Your interaction with the EG Labs Site and Offerings is subject to you registering or holding an account with our One Key loyalty program or another of our participating rewards programs, and you must be logged in to your account to use the EG Labs Site. Please take note of the relevant current terms for your relevant program as set out in the General Terms (including as applicable, Hotels.com Rewards Terms and Conditions and Expedia® Rewards Terms and Conditions). 

AI model and other inputs, feedback, comments and suggestions 

You agree that any inputs, such as for generative AI models used in connection with the EG Labs Site, Offerings, or any further Service or Site are Submissions (as defined under the General Terms) and thus, are governed by the General Terms. Additionally, you agree that your use of any generative AI models will only be used for travel planning-related purposes such as to assist with a creating or updating a travel itinerary. Any feedback you provide, including comments, suggestions, ideas, or the like, regarding any pre-production products and services or otherwise ("Feedback") provided by you to the EG Labs Site, Offerings, or any further Service or Site are governed by the following where you:

• confirm that all Feedback is your original creation and that you have and will maintain all rights necessary to allow us to use the Feedback as set out in these Terms,
• hereby irrevocably assign to our Group of Companies all rights, title, and interest in the Feedback, or, if that is not possible, you grant our Group of Companies as permitted by law, a non-exclusive, royalty free, perpetual, transferable, irrevocable, fully paid-up and fully sub-licensable through multi-levels right to use, reproduce, modify, adapt, translate, distribute, publish, create derivative works from and publicly display and perform such Feedback throughout the world in any media, now known or later devised so that our Group of Companies may use Feedback without obligation to you. Furthermore, the rights provided by this license also permit our Group of Companies to use Feedback as inputs into one or more generative AI models, or to otherwise optimize, maintain, update, train, retrain, or otherwise improve one or more generative AI models, and
• disclaim any ownership rights to any output provided based on the use of any generative AI models.

You acknowledge that our Group of Companies owns all rights, title, and interest in and to any output generated by one or more generative AI models. You also agree to any applicable terms and conditions corresponding to the one or more generative AI models used by any of the pre-production products and services.

You also acknowledge and agree that our Group of Companies and our Partners may choose to use the name that you submit with Feedback to attribute your Feedback (for example, listing your first name and hometown on comments that you submit) at our discretion in a non-identifiable format. Such Feedback may also be shared with the Travel Providers.

You also grant our Group of Companies the right to legally pursue any person or entity that violates your or our Group of Companies’ rights in the Feedback.

If possible, you expressly waive any and all ‘moral rights’ (including rights of attribution or integrity) that may subsist in your Feedback. You agree that you have no objection to the publication, use, modification, deletion or exploitation of your Feedback by our Group of Companies, our Partners or any of our other licensees.

You are fully responsible for the content of your Feedback as well as your use of any generative AI models. You must not post or transmit to or from our Service or Site and agree that any Feedback you provide and/or use of any generative AI models do not contain any content that:

• is false, unlawful, abusive, threatening, libelous, defamatory, obscene, pornographic, or would violate publicity or privacy rights or any law,
• is commercial (such as solicitation of funds, advertising, or marketing of any goods or services, etc.),
• infringes, misappropriates or violates any copyright, trademark, patent or other proprietary right (such as rights to confidential information) of any third-party, or
• is objectionable on the grounds of public interest, public morality, public order, public security or national harmony

You will be solely liable for any damages resulting from not complying with the rules above, or any other harm resulting from your submission of Feedback or your use of any generative AI models.

We may exercise our rights (for example: to use, publish, display, delete, etc.) to any Feedback without notice to you.

Feedback remains subject to our Content Guidelines as set out in the General Terms.

You acknowledge that our Group of Companies owns all rights, title, and interest in and to any output generated by one or more generative AI models. You also agree to any applicable terms and conditions corresponding to the one or more generative AI models used by any of the pre-production products and services, including OpenAI’s Terms of UseOpens in a new window, Usage PoliciesOpens in a new window, Product Safety StandardsOpens in a new window, and Service TermsOpens in a new window.

Continuation of Rights and Obligations Post Opt-Out

You may request to opt out of the EG Labs Site by selecting “opt out” on the Expedia mobile application. By selecting ‘opt-out’ you will (1) no longer receive email correspondences regarding the EG Labs Site, and (2) you will have restricted access to the EG Labs Site. However, your opt-out request shall not affect the validity or enforceability of the portion of these terms pertaining to the rights, obligations, representations, warranties, and/or indemnities granted by you to our Group of Companies, as established prior to the opt-out, with respect to Feedback, inputs into generative AI models, and outputs from generative AI models. By opting out, you acknowledge and agree that these specific rights, obligations, representations, warranties, and indemnities will survive the opt-out request and will continue to be binding and enforceable on you.
